Growing System Failures, Shutdowns, and Aging Infrastructure Converge to Revive Long-Stalled Corporatization Effort
WASHINGTON — A confluence of crises—from January's fatal midair collision over the Potomac to chronic government shutdowns affecting controller pay, coupled with federal auditors deeming 37% of air traffic control systems "unsustainable"—has created what reform advocates believe is the strongest political opportunity in decades to restructure America's air navigation services.
Despite Transportation Secretary Sean Duffy's August 2025 dismissal of privatization as a "distraction," aviation industry stakeholders and policy experts say the current chaos may force a reconsideration of governance models that have succeeded internationally while remaining politically untouchable in the United States.
Learning From Four Decades of Failed Attempts
The history of US air traffic control reform reads as a chronicle of political defeat. From the Reagan administration's 1983 proposal through President Clinton's 1994 U.S. Air Traffic Services (USATS) corporation plan to the most recent serious effort—Rep. Bill Shuster's 21st Century AIRR Act in 2016-2018—every attempt has foundered on the same political obstacles.
The AIRR Act came closest to success. Shuster (R-PA) introduced H.R. 2997 on June 22, 2017, with President Trump's endorsement. The House Transportation and Infrastructure Committee passed it 32-25 on June 27, 2017. The legislation would have created a federally chartered, not-for-profit corporation to operate ATC services while keeping the FAA as safety regulator—closely modeled on Canada's Nav Canada.
Yet it never reached the House floor, killed by an unlikely coalition: wealthy private aviation interests, rural Republicans fearing service cuts to small airports, constitutional concerns from the Congressional Research Service, and labor unions worried about privatization impacts.
"Politics is the main reason why we haven't seen that happen in the United States," says Marc Scribner of the Reason Foundation, which has advocated for ATC reform since 1981.
The Nav Canada Model: Proven Success, Political Kryptonite
Nav Canada, established in 1996 when the Canadian government sold its air navigation services for C$1.5 billion, has become aviation's most cited—and most contentious—example of successful ATC corporatization.
The non-profit corporation is governed by a 15-member board representing four stakeholder groups: commercial carriers (4 seats), government (3 seats), labor unions (2 seats), and general aviation (1 seat). These 10 members elect four independent directors, who together appoint the CEO as the 15th member.
Results speak for themselves: Nav Canada handles 50% more traffic with 30% fewer people than comparable government-run systems. The company completed nationwide electronic flight strip deployment in 11 years—a system the FAA only began implementing in 2023. Nav Canada actually reduced fees in 2007 when revenues exceeded operational needs.
"Flying over the US-Canadian border is like time travel for pilots," Wall Street Journal columnist Scott McCartney wrote in 2016. "Going north to south, you leave a modern air traffic control system run by a company and enter one in which the government is struggling to catch up."
Yet Nav Canada's success has paradoxically hindered US reform. Bernard Gervais of the Canadian Owners and Pilots Association has asked US general aviation groups to "stop using Canada as your example" of why privatization shouldn't happen—because the Canadian system actually works well for small aircraft operators.
A Politically Viable Structure for the United States
Based on lessons from past failures, a reformed US system could center on the American Air Navigation Services Corporation (AANS)—a non-governmental, non-profit entity with no taxpayer guarantee for assumed debt.
The critical innovation would be a 13-member board giving general aviation more representation than airlines: Airlines (2 seats), General Aviation (3 seats), Labor (2 seats), Government (2 seats), Airports (1 seat), and Independent Directors (3 seats elected by stakeholders). The CEO becomes the 14th voting member.
General aviation aircraft under 12,500 pounds would be exempt from new fees, addressing the sector's primary objection. Fee changes would require Transportation Secretary approval after public comment, with discriminatory fees subject to court challenge.
Unlike the FAA, the corporation could issue revenue bonds and operate outside federal procurement regulations, which in Canada added 25-50% to equipment costs. This would enable rapid deployment of space-based surveillance, digital towers, and AI-assisted traffic management.
The FAA would retain all safety regulatory functions—aircraft certification, pilot licensing, rulemaking—eliminating the conflict of interest from regulating services it provides. This follows ICAO recommendations and EU mandates that the US alone rejects among major aviation nations.
The Compromise Path
Rather than immediate nationwide rollout, a five-year pilot program in select regions with annual Congressional review could prove viability before full implementation. If performance metrics aren't met, FAA could resume operations.
For rural Republicans, the structure guarantees board representation and service level mandates. For labor, no involuntary layoffs for five years and collective bargaining preservation. For constitutional concerns, Transportation Secretary oversight and Congressional reporting maintain government authority.
Why Now?
Government shutdowns, the January 2025 DC collision, Newark flight reductions, and GAO findings that 51 of 138 systems are unsustainable create unusual convergence. Congress appropriated $12.5 billion for modernization, showing funding appetite—but also that money alone hasn't solved decades of failures.
While Senator Duffy dismissed privatization, his qualifier—"someone else can have at some other point"—leaves the door open. A July 2025 Senate bill prohibiting privatization planning suggests opponents recognize the renewed threat.
The Fundamental Question
More than 60 countries have corporatized ATC services—Canada, UK, Germany, Australia, New Zealand. All share separation from safety regulation, user-fee funding, operational independence from politics, and stakeholder governance.
"It is ironic that America, a bastion of capitalism, should be the only major country with a fully public air traffic control system," notes Heritage Foundation analysis.
The technical case is overwhelming. International evidence is compelling. Current failures are documented. What remains uncertain is whether political courage can match technical necessity—or whether policymakers will wait for the next accident before acting on evidence already in hand.
